1212 POLO & TURF RESORT: RIDING SCHOOL TERMS, CONDITIONS, & POLICIES

A. APPLICATION, ACCEPTANCE, & INDUCTION

1. Riders or legal guardians should ensure that they have filled out and endorsed the necessary fields for the following documents:
a. Riding Application Form (Online)
b. Horse Code of conduct and this document (Terms, conditions, and policies) (Riding school office)
2. Do note that all documents need to be read through, filled out, ticked, and signed before the commencement of any activity. Riders will not be permitted to ride if any of the aforementioned is incomplete or not submitted.
3. After successfully finishing the paperwork, you’ll be invited for a visit to familiarise yourself with the environment and expected routine.
4. An appropriate schedule will be communicated after which you may start classes.

B. FEES, DISCOUNTS, AND REFUND POLICIES

1. No installments or part payments. Only full payment validates services and the selected/preferred booking.
2. All fees are to be paid in FULL before confirmation of booking, slots, or commencement of any activity.
3. All fees paid are NON-REFUNDABLE. This includes but not limited to application form fees, lesson fees, etc. Only exceptions for refunds are discussed in ‘Section E’.
4. Validity: All classes, services, & packages paid for and booked/scheduled must be completed within the specified validity period or result in a forfeit due to defaulting (with no refund.)
• Beginner class is 10 lessons completed in 4 weeks: it is valid for 8 weeks maximum from initiation date.
• Novice class is 11 lessons & the Advanced class is 12 lessons all are to be completed in 6 weeks: both mentioned classes are valid for 10 weeks from initiation date.
• All other services are valid for 2 weeks from the booking date.
5. Discounts: Time to time we give special discounts and promos. Subject to management discretion, for adults only one discount applies, whereas for children two discounts may apply.
6. Any awards, rewards, discounts, or prizes are valid for 2 months by default OR as stated on the promo, flyer, or offer. They can’t be redeemed after the stipulated time.

C. ATTENDANCE, SCHEDULING, POSTPONEMENT, AND RESCHEDULING

1. Duration: all lessons are 45 minutes long per session. Lessons will always start and finish at the scheduled time, so as not impinge into others’ allotted time.
2. Lateness: If you are late arriving for your lesson, note the lesson will still finish at the scheduled time.
3. If you are more than 15 minutes late, your scheduled horse will be returned to the stables and your lesson will be counted as a no-show with no make-up lesson.
4. Regular class attendance is vital for students to develop confidence and skills to become a skilled horse rider. Students must be punctual and motivated to get results. As such endeavour to arrive at least 15minutes to the lesson time.
5. Three consecutive no-shows will result in loss of lesson time slot.

Rescheduling Of Lesson(s)
6. 24-hour policy is required for rescheduling of any lesson regardless of the reason.
7. If rescheduling is initiated in less than the 24-hour notice, the lesson will not be rescheduled unless the reason is valid and proof is provided, all subject to management’s approval. Please remember that the instructor, groom, arena and horse have already been allotted for your booking thus the 24-hour notice.
8. If rescheduling within the 24-hour notice, the lesson can be rescheduled within the same calendar month.
9. Once the Client has been booked into the system, at whatever time or date it rolls over weekly unless you’ve been contacted with a change notice.
10. No show/no advice for 3 consecutive weeks will result in us removing a client/rider from our calendar booking. The remaining lessons will be placed on hold until the client calls back to rebook OR will be voided upon expiration of the validity period
11. Rescheduling of lessons can only be done via one of the following methods:
i. Email 1212poloandturf@gmail.com
ii. Whatsapp 09123120120 (or which is provided henceforth)
Note: Rescheduling of lesson(s) made via any other method will not be processed.

Weather
12. In the event of extreme weather conditions (heatwave, fog, dust, rain, or wet conditions), the riding instructor will make the final decision as to whether lessons will be postponed or not. Clients will be notified of any postponement a few hours to the time.
13. Where you haven’t been stopped from coming, you should proceed with the normal booking/lesson schedule. If in doubt, the client can always to contact us via Whatsapp or Email to confirm whether lessons will be holding or not.

D. ACCOMPANYING

1. Before our changing rooms and lockers are ready, please note the following with regards to accompanying riders for lessons.
• 1 person ONLY is sufficient to accompany a rider for lessons.
• Children (4-11 years) MUST be accompanied by an adult at all times for the whole duration of the lesson. You are not leave your ward unattended. Noncompliance will be penalised.
• Outside the above-mentioned, any additional person wishing to accompany a rider must seek permission first, otherwise, we’ll turn them back.
• For Equestrian Scholars, a maximum of 2 adults (teachers and/or parents) MUST accompany the students from their respective school premises’, stay for the whole lesson, and leave with them. Noncompliance will be penalised.
• Flash photography, loud or sharp noises, and other distracting activities are NOT permitted by the accompanying adult(s).
2. Visits: being a riding school with a lot of outdoor work, non-linear work schedule etc., the offices aren’t always manned and walk-in visitors won’t readily have someone to attend to them. Thus,
• No walk-ins are allowed without a prior appointment. Ready access is limited to ACTIVE riding students only on their respective lesson days.
• Logbooks are ticked at the gate and the riding school office for regular attendance checks.
• Any visit outside lesson days by clients (riders) has to be scheduled via phone (WhatsApp) or email. We reserve the right to turn back anyone who doesn’t comply with the above.
3. Loitering/redundance: due to incomplete entertainment, dining, and lounging facilities (i.e., games, restaurant, clubhouse),
• We advise riders, that 30 minutes early arrival is good enough so that they won’t be redundant. We don’t allow clients coming more than 30 minutes early for their lessons.
• Also, once done with your lesson, and after you’ve caught your breath in a 15-minute window, we encourage you to depart so the other riders and their company can also focus. Your privacy (and comfort) is key to us.

E. TERMINATION OF LESSON(S)

1. The school reserves the right to terminate a rider’s lessons for noncompliance, misconduct, and/or no-show (as detailed above).
2. Client may request for termination also, but only on medical grounds. It is then at the school’s discretion to determine the peculiarity of the case to agree if it
warrants a refund or not. For such refunds to be processed we’ll require a medical certificate/diagnosis. Processing of refunds initiates after confirmation. The processing time is within 21 working days. Total amount refundable is 85% of sum paid after deducting any lessons already covered.
3. Termination of lesson(s) can only be done via one of the following methods:
i. Email ONLY
Note: Termination of lesson(s) made via other methods, other than the above-mentioned will not be processed.

F. HEALTH, SAFETY, & SANITARY

1. All riders must sign the Disclaimer waiver before riding or participating in any event on the property.
2. Please make sure you are correctly dressed at all times not only when mounted/riding. That is to say, before you even go near the stables ensure that your riding hats/helmets, riding boots, and other attire is worn. Up until you’re done with the lesson and horses are returned.
3. Instructions from Instructors must be followed at all times.
4. Do not stand, climb, or rest on the railings and fences.
5. No running, screaming, walking behind a horse, running or chasing after a loose horse.
6. During group lessons, if a rider falls and you are in the same arena, stop your horse and wait for instructions.
7. 1212 Polo & Turf Resort is not liable for personal injury sustained or any loss or damage of personal property whilst on the premises, as such you are required to sign the indemnity release.
8. 1212 Polo & Turf Resort aims to provide a safe learning environment to reduce risk of injury. It should be recognised by all guests, students, and parents/guardians that horse riding by its very nature carries a risk of accident and/or injury.
9. 1212 Polo & Turf Resort provides instructors and staff, who actively promote safe practices for all disciplines and activities. However, it should be understood that injuries do occur from time to time and students must accept this element of risk.
10. It is pertinent to be honest and forthcoming on all forms filled and questions asked regarding health conditions and general wellbeing. This is important for the resort to properly assess the viability of a person’s interest in any activity selected.
11. Where we have advised against participation in certain activities and/or levels of exertion, we will require a signed and notarized medical certificate from the client’s physician before acceptance and/or commencement.
12. Disposal of refuse should be done properly in trash cans and bins. Failure to do so attracts unwanted insects and animals that will further cause littering. Defaulters will be fined N5,000.00 subsequent transgressions will result in termination
13. Proper use of sanitary facilities is enshrined. Do not clog the WC with unwarranted objects. Don’t force the handles, buttons, and faucets. Do not wet the floors. Clean up after yourself, making it suitable for another person’s immediate use.

Gear
14. All participants MUST wear the proper (and approved gear). This is subject to the various set standards. Helmets (hats) are mandatory, approved shoes/boots, breeches, or full-length trousers will all be inspected before commencement. NO exceptions. This exempts staff. Some gear will be provided by the resort, such as helmets, gloves, and chaps. However, riders are encouraged to acquire theirs.
15. Equipment rental: this follows the present pricelist at the Riding school office. However, for first-timers (Beginner class, assessments, etc) we don’t charge a fee, but for novice and advanced class, the rider must pay applicable rental fees.
16. All Riders are liable for gear & equipment used. In the case of minors, the adults must ensure that borrowed gear- is taken, used, and returned properly. We are to be fully compensated for any damaged equipment or gear.
17. Helmets must fulfil the minimum safety standards of:
• PAS015 (1998 or 2011) with BSI Kitemark
• 0404: (2014 – 12) with BSI Kitemark
• ASTM F1163 (2004a or 04a onwards) with SEI mark
• SNELL E2001: with official SNELL label and number
• AS/NZS3838 (2006 onwards) with SAI Global Mark
18. Shirts and trousers
• Please come attired in comfortable sleeved top (T-shirt, Polo shirt, etc.);
• Comfortable full-length trousers (jodhpurs, breeches, good-fitting khakis, denim, jeans, etc.) NO shorts or ¾ pants
• If wearing jeans or denim, try this ratio Cotton 95% Polyester 5% – Cotton 98% Polyester 2%
• Correct footwear worn with socks i.e., riding boots or paddock boots or shoes that have a smooth sole and small heel (no more than an inch), OR evenly surfaced sports shoes/trainers.
19. Accessories & Gadgets
• You MUST wear the sweat-absorbing bandana or skullcap we provide you before wearing our helmets. Even if it’s your helmet, we insist you wear one especially during warmer times.
• Long hair must be tied back and held in place with a net, band, etc. to ensure a good fit of the helmet and prevent distractions.
• Ensure your nails are not long whether you are wearing gloves or not. You stand to injure yourself (by improper or forceful gripping) or involuntarily scratching the horse.
• NO dangling earrings, tight and/or bulky rings, or any piece(s) of jewellery that will disrupt proper riding etiquette.
• Ensure you have empty pockets. No bulges or the likes, so that nothing will pinch you, affect posture, and riding form.
• NO phones or similar device(s) that can emit sound and vibration whilst mounted. Failure to do so is likely to spook a horse
• Headset, ear/air pods, earpieces, and other gadgets are not permitted while horse riding or next to horses.
20. If a student has a fall OR injury during a lesson a parent or guardian will be notified. If a student falls and has contact with their head on the ground they will not be able to mount the horse again due to possible concussions. This decision is made by the instructor present when the fall occurred.
21. Restricted areas: All riders and non-riders must abide by the rules at the resort by not stepping into designated restricted areas.
22. Non-riders are allowed to watch the lessons from the viewing areas and must refrain from interfering while a student is in class. This includes-
a. Not approaching the perimeter (sitting on railings is forbidden).
b. No flash photography.
c. No sudden movements.
d. No distraction allowed- loud and or sharp noises. The student needs to hear the instructor’s voice AND this is a quiet area as horses are sensitive to noise and this is for horse and rider safety.
e. If participants have children, it is their responsibility to keep them in check and supervise them at all times on the premises.
23. School clubs (Equestrian Scholars) must have a minimum of 1 Supervisors/Teacher for every 10 students accompanying them for every session. Our preference is however 2 adults.
24. Weight restriction- weight restriction for the riding school activities is 80kgs for the small to average-sized horses and 110kg for the large horses. We are not able to take heavier riders. You can enroll in our wellness & fitness club to bring your physique to a suitable level for equestrian activities. Where a participant declines this, we reserve the
right to turn away participants who are over this weight limit. This is in the interest of both the horse and the riders’ safety.
25. Mount: You will be allocated horses suitable for your ability at any given time based on the instructor’s discretion. We cannot guarantee that you will ride the same horse every lesson. We believe that riding different horses ensures you become a better rider. We encourage riding different horses to gain more knowledge and confidence.
26. For Schools and organisations, the Management shall set a schedule for lessons/activities to accommodate their timetable but ultimately, the schedule presented by the resort prevails.
27. No direct or indirect feeding of domesticated animals, horses especially. Only exception is if with permission or under supervision for example- as a part of a lesson or scheduled activity. Defaulters will be penalized N50,000.00. And where such unauthorized feeding leads to complications or death of an animal, the defaulters will be liable to the full extent of the damages.
28. No direct or indirect feeding of nondomesticated birds/animals. Littering of edible matter is considered indirect feeding. Defaulters will be penalized N10,000.00
29. Age: The minimum age of enrolment is 4 years. Maximum is subject to assessment of physical wellbeing.

G. COMPLAINTS & FEEDBACK

If you are happy with the service, lessons, horses, our people, the facility, etc please give us positive feedback and encouragement. This can be done on google maps reviews, social media (@1212poloandturf), via email or WhatsApp (09123120120).
If you are unhappy about anything that is happening here, please talk with someone on our management team, preferably during business hours. Usually, most problems can be sorted through proper communication. If not, there is a process that will be outlined by anyone of our management team, which will include putting any complaints in writing via email (1212poloandturf@gmail.com)

H. VIDEO AND PHOTO POLICY

By entering 1212 Polo & Turf Resort Club premises, you enter an area where photography, audio and video recording may occur by us. While on the premises, you consent to interview(s), photography, audio recordings, video recordings and its/their release, publication, exhibition or reproduction to be used for news, webcast, promotional purposes, telecast, advertising, inclusion on websites, social media or any other purpose by 1212 Polo & Turf Resort, its affiliates and representatives. Images and/or videos may be used to promote and exhibit the capabilities of 1212 Polo & Turf Resort in the future. You release 1212 Polo & Turf Resort, and its recordings. By entering the resort premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, webcasting, televising, or other publication of these materials; regardless of the purpose.
You also waive any right to inspect or approve any photo, video or audio recording taken by 1212 Polo & Turf Resort or the person or entity designated to do so by 1212 Polo & Turf Resort. You have been fully informed of your consent, waiver of liability and release before entering the premises of 1212 Polo & Turf Resort.

G. HOUSE RULES

1. Any form of ill-treatment towards guests, animals, and staff will not be tolerated.
2. When passing other horses on the yard, please pass on the left side.
3. Please put all your rubbish in the bins provided before you leave.
4. All riders are requested to respect other riders.
5. Children under 10 years of age must be supervised at all times. If you are riding or caring for your horse, please make sure someone is responsible for your child.
6. Smoking on horseback is strictly prohibited. DO NOT DROP YOUR CIGARETTE BUTTS ON THE GROUND. Please use an ashtray and help keep our resort clean.
7. All Horses have right-of-way.

I. DEED OF RELEASE, ASSUMPTION OF RISK AND INDEMNITY FORM

I acknowledge that participation in any Polo/Riding activities requires me to be cautious and caring in handling and riding horses, which are unpredictable in nature. Riding like most sports, has its risks. I acknowledge that the choice to ride is voluntary, I acknowledge the importance and use of safety gear and attire and I acknowledge that most insurance companies will not cover personal accident claims if approved and recommended safety attire is not worn at the time of an incident. This means I am liable for neglect should I choose to ride without a recognized and approved safety attire. It is compulsory for anyone riding at 1212 Polo & Turf Resort to wear approved set of safety attire in line with the sport’s/activity’s recommended guidelines. I willingly accept all responsibility for injuries to myself and or others however caused by my horse or by myself. I acknowledge that purchased lessons are exclusive and non-refundable. In consideration for my participation in said activities, I hereby release and forever discharge 1212 Polo & Turf Resort, and its officers, board, and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the activities, I hereby accept and agree to the following conditions:
▪ To follow appropriate riding attire/dress code policy.
▪ To follow scheduling, rescheduling, and termination policy.
▪ To abide by all instructions including health and safety instructions as directed by 1212 Polo & Turf Resort at all times whilst at the premises.
▪ To pay every fine that is attracted by any rule/regulation infringement committed by me.
▪ To disclose herein any previous or current ailment, injury or condition that may affect or could be considered dangerous or unsuitable for participation in riding and other activities. Notification of new ailments to be made at the first available opportunity in writing to 1212 Polo & Turf Resort upon determination thereof.
▪ To release 1212 Polo & Turf Resort, their employees, agents and any third party assisting in the organization or delivery of riding or other activities free of all liability for death and/or personal injury arising out of any accident or incident occurring during riding or other activities and or at the premises.
▪ To release 1212 Polo & Turf Resort, their employees, agents and any third party assisting in the organization or delivery of riding and other activities free of all liability for any loss or damage of any personal belonging (including vehicles) whilst on the premises.
▪ This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any state, federal, local or territorial law or state providing substance that releases shall not extend to claims, demands, injuries, or damages which are known or unsuspected to exist at this time, to the person executing such release, are hereby expressly waived. ▪ To release such personal belongings at my own risk and responsibility.
▪ To refrain from consuming alcohol prior to or during the participation of any form of activity whilst on the premises.
▪ To show up for the lesson on time. In the case of running late, time of the lesson will be shortened accordingly. If rider showed up for lesson 15 min after scheduled time, assigned horse will no longer be there and no refunds or rescheduling will be made. (As outlined in ‘Section C’)
▪ Validity of the lessons package or single lesson purchased is 12 weeks (3 months). After that time, if no medical certification with contraindications for riding was presented lessons will not be any longer available for continuance or redemption. (As outlined in ‘Section B’)
▪ Giving due notice of the fact and truth, and of being of full legal competence, by ticking/reading/signing this section, I have signed the Disclaimer in due form and constitute full understanding and acknowledgement of the stipulations stated herein.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE 1212 POLO & TURF RESORT.

IMPORTANT NOTICES
Please note all Terms and Conditions and information stated in the paper are subject to change without any prior notice. Please also note that the Management reserves the right to disallow any riders, accompanying family members and/or friends into its premises if they choose not to adhere to the Resort’s rules and regulations. Subsequent actions will be at the management’s discretion.
